Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Kichacha ("we", "us", "our") governing your access to and use of the Kichacha mobile application (iOS and Android) and the website at kichacha.com(together, the "Service").

By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Eligibility

  • You must be at least 18 years of age to create an account and use the Service.
  • By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
  • You must not have been previously suspended or removed from the Service.
  • You must comply with all applicable local, national, and international laws and regulations.

3. Account Registration and Security

3.1 Account Creation

To access most features of the Service, you must create an account by providing a valid email address, mobile phone number, and password. You agree to provide accurate, current, and complete information during registration and to keep this information up to date.

3.2 Account Security

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You must immediately notify us at support@kichacha.com if you suspect any unauthorised use of your account.
  • We are not liable for any loss or damage arising from your failure to secure your account.

3.3 One Account Per Person

Each person may maintain only one active Kichacha account. Creating multiple accounts, or creating an account on behalf of another person without their authorisation, is prohibited.

4. Your Profile

  • Your profile information (name, photos, bio, dance preferences) will be visible to other Kichacha users.
  • You must ensure that all information and media you upload is accurate, belongs to you, and does not infringe on any third party's rights.
  • You must not impersonate any person or entity, or misrepresent your identity, age, or affiliation.
  • Profile photos must clearly depict you. Photos of other people, celebrities, animals, objects, or AI-generated images presented as real photographs are not permitted.
  • We reserve the right to remove any content that violates these Terms without prior notice.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Harass, abuse, threaten, stalk, or intimidate any other user.
  • Post or transmit content that is defamatory, obscene, pornographic, violent, hateful, discriminatory, or otherwise objectionable.
  • Use the Service for any commercial purpose, advertising, or solicitation without our prior written consent.
  • Spam, send unsolicited messages, or use the messaging system for bulk communication.
  • Collect, harvest, or scrape user data or content from the Service.
  • Use automated systems, bots, scripts, or crawlers to access or interact with the Service.
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
  • Circumvent, disable, or interfere with security features of the Service.
  • Upload viruses, malware, or any code designed to disrupt, damage, or limit the functionality of the Service.
  • Create accounts using false information or another person's identity.
  • Use the Service while under the age of 18.

6. Interactions with Other Users

6.1 Your Responsibility

You are solely responsible for your interactions with other users. We do not conduct background checks on users and do not verify the accuracy of user-provided information. Exercise caution and good judgement in all interactions, especially when meeting in person.

6.2 Safety Guidelines

  • Always meet in public places for initial in-person meetings.
  • Inform a trusted person about your plans when meeting someone from the Service.
  • Do not share personal financial information with other users.
  • Report any suspicious, abusive, or inappropriate behaviour to us immediately.

6.3 No Guarantee

We do not guarantee the accuracy of user profiles, the behaviour of users, or any particular outcome from using the Service. Kichacha is not responsible for the conduct of any user, whether online or offline.

7. Event Organizer Terms

If you register as an Event Organizer and submit events through the Kichacha web portal:

  • All event submissions are subject to review and approval by Kichacha administrators. We reserve the right to reject any event submission for any reason.
  • You must ensure that all event information is accurate, complete, and not misleading.
  • You are solely responsible for the events you organise, including compliance with local laws, permits, venue safety, and attendee welfare.
  • Kichacha is not a co-organiser, sponsor, or participant in any events listed on the platform.
  • We may remove approved events at any time if they are found to violate these Terms or applicable law.

8. Content Ownership and Licence

8.1 Your Content

You retain ownership of all content you upload or create through the Service (photos, videos, bio text, messages). By uploading content, you grant Kichacha a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, display, and distribute your content solely for the purpose of operating and improving the Service. This licence terminates when you delete your content or account, except for content that has been shared with other users (e.g., messages in conversations) which may persist in the other user's view.

8.2 Our Content

The Service, including its design, features, algorithms, code, graphics, logos, and branding, is owned by Kichacha and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

9. AI and Matching

Kichacha uses algorithmic and AI-assisted features to enhance your experience:

  • Match scoring: compatibility scores are calculated from your profile attributes, dance preferences, location, and interaction patterns.
  • Semantic matching: your bio text is processed by OpenAI's embedding model to identify similarity with other users' bios.
  • Personalised ranking: discovery results are ranked based on learned preference weights derived from your swipe history.

These features are designed to assist — not replace — your own judgement. We do not guarantee the quality, accuracy, or suitability of any match. AI-generated scores are provided as suggestions only.

10. Account Suspension and Termination

10.1 By You

You may delete your account at any time through the Account Deletion page or by contacting us. Upon deletion, your data will be removed as described in our Privacy Policy.

10.2 By Us

We may suspend or permanently terminate your account, without prior notice, if:

  • You violate these Terms or any applicable law.
  • Your conduct poses a risk to the safety or well-being of other users.
  • We reasonably believe your account has been compromised.
  • We are required to do so by law or a regulatory authority.
  • We discontinue the Service or any part of it.

11. Disclaimers

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.
  • We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
  • We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not endorse, verify, or guarantee any user-generated content, profiles, or interactions.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Kichacha, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.
  • Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you have paid to Kichacha (if any) in the 12 months preceding the claim.
  • We are not liable for any loss or damage resulting from your interactions with other users, whether online or in person.

13. Indemnification

You agree to indemnify, defend, and hold harmless Kichacha and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, your content, or your interaction with other users.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable law in the jurisdiction where Kichacha operates. Any disputes arising from or relating to these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of the applicable jurisdiction.

15. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

16. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will notify you through the app or by email at least 14 days before the changes take effect. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kichacha with respect to the Service and supersede all prior agreements, representations, and understandings.
